It addresses the fundamental issues of the subject, and contributes to legal theory and practice. Topics discussed include foundations of the complex relationship of competition law and regulation, new forms of advocacy powers of competition agencies, competition law enforcement in regulated industries in general, information and telecommunications markets, and competition law as regulation in IP-related markets. Scholars in the two fields of law and economics will find the research aspects of the book to be of interest. Competition And Regulation by Paul Cook, Leading Issues In Competition Regulation And Development Books available in PDF, EPUB, Kindle, Docs and Mobi Format. Download Leading Issues In Competition Regulation And Development books, The promotion of liberalized and deregulated markets by bilateral and multilateral aid donors, and by global institutions such as the WTO, has led to significant attention being paid to competition and regulatory reforms in developing economies. The process of reform involves the transfer and diffusion of market models derived from practice and theory in developed countries. However, in developing countries, regulation needs to do more than simply promote competitiveness and consumer interests: it also needs to ensure that the market nurtures development. By rigorously examining the numerous impacts of regulation, this book will help to fill a significant gap in the literature on economic and social development. The book, now available in paperback, draws together contributions from leading experts across a range of disciplines including economics, law, politics and governance, public management and business management. The authors begin with an extensive overview of the issues of regulation and competition in developing countries, and carefully illustrate the important themes and concepts involved. Using a variety of country and sector case studies, they move on to focus on the problems of applicability and adaptation that are experienced in the process of transferring best practice policy models from developed to developing countries. The book presents a clear agenda for further empirical research and is notable for its rigorous exploration of the links between theory and practice. Although there is substantial interest in competition and regulation, as yet there has been relatively little investigation of these issues in developing economies. This book redresses the balance and will be a valuable resource for researchers, academics, teachers and students interested in development economics and development studies. It will also be of great relevance for practitioners and policymakers working in the fields of competition policy and regulatory reform.
Competition And Regulation by Caroline Mutuku, Competition Regulation And Regulatory Governance Books available in PDF, EPUB, Kindle, Docs and Mobi Format. Download Competition Regulation And Regulatory Governance books, Seminar paper from the year 2018 in the subject Business economics - Economic Policy, grade: 1, language: English, abstract: In the global economy, privatization has become a central issue within economic reforms taking place in developing countries, and it is associated with the neo-liberal model reforms from the 1980's. Developing countries struggle to maintain high standards in public services such as water, energy, telecommunications, transportation, health, education, and, therefore, the adoption of policies to increase the effectiveness are needed. Privatization in theory should help these entities to become more efficient and benefit the majority of the population though, in practice, these objectives are rarely accomplished. The role of competition and regulation in such businesses are essential for development and growth, especially through the injection of private capital and fostering of competition. The principal common factor of these businesses is the natural component of monopolies which, according to Hellwig (2008), represents the use of a fixed network infrastructure that translates into largely sunk costs. Federal reforms aim for the improvement of performance in such important sectors of public services; however much of the research proves that; this has been reasonably unsuccessful in developing countries based on lack of institutional capacity. Even in theory, regulatory framework imported from developed countries was not suitable to the social and economic context in developing countries consequently the application of such previous experiences was not productive. This paper attempts to show that competition and regulation in the privatization process within developing countries could be successful if necessary reforms are based on the country's economic, social, and political structure. As mentioned, the privatization process, as successfully applied in developed countries, requires significant adjustment for it to be pursued in transitiona

Competition And Regulation by Steven Truxal, Competition And Regulation In The Airline Industry Books available in PDF, EPUB, Kindle, Docs and Mobi Format. Download Competition And Regulation In The Airline Industry books, An examination of the relationship between competition and the deregulation and liberalisation of the US and European air transport sectors reveals that the structure of the air transport sector has undergone a number of significant changes. A growing number of airlines are entering into horizontal and vertical cooperative arrangements and integration including franchising, codeshare agreements, alliances, ‘virtual mergers’ and in some cases, mergers with other airlines, groups of airlines or other complementary lines of business such as airports. This book considers the current legal issues affecting the air transport sector incorporating recent developments in the industry, including the end of certain exemptions from EU competition rules, the effect of the EU-US Open Skies Agreement, the accession of new EU Member States and the Lisbon Treaty. The book explores the differing European and US regulatory approaches to the changes in the industry and examines how airlines have remained economically efficient in what is perceived as a complex and confused regulatory environment. Competition and Regulation in the Airline Industry will be of particular interest to academics and students of competition law as well as EU law.

Competition And Regulation by Xavier Vives, Competition And Stability In Banking Books available in PDF, EPUB, Kindle, Docs and Mobi Format. Download Competition And Stability In Banking books, A distinguished economist examines competition, regulation, and stability in today's global banks Does too much competition in banking hurt society? What policies can best protect and stabilize banking without stifling it? Institutional responses to such questions have evolved over time, from interventionist regulatory control after the Great Depression to the liberalization policies that started in the United States in the 1970s. The global financial crisis of 2007–2009, which originated from an oversupply of credit, once again raised questions about excessive banking competition and what should be done about it. Competition and Stability in Banking addresses the critical relationships between competition, regulation, and stability, and the implications of coordinating banking regulations with competition policies. Xavier Vives argues that while competition is not responsible for fragility in banking, there are trade-offs between competition and stability. Well-designed regulations would alleviate these trade-offs but not eliminate them, and the specificity of competition in banking should be accounted for. Vives argues that regulation and competition policy should be coordinated, with tighter prudential requirements in more competitive situations, but he also shows that supervisory and competition authorities should stand separate from each other, each pursuing its own objective. Vives reviews the theory and empirics of banking competition, drawing on up-to-date analysis that incorporates the characteristics of modern market-based banking, and he looks at regulation, competition policies, and crisis interventions in Europe and the United States, as well as in emerging economies. Focusing on why banking competition policies are necessary, Competition and Stability in Banking examines regulation's impact on the industry's efficiency and effectiveness.

Competition And Regulation by Robert W. Crandall, Changing The Rules Books available in PDF, EPUB, Kindle, Docs and Mobi Format. Download Changing The Rules books, Since 1971 competition has begun to replace regulation as a governing force in the telecommunications industry. The breakup of the national telephone monopolies, technological advances, and the worldwide network in telecommunications have brought a revolution in the telecommunications equipment and services industries. These changes have forced legislators and regulators to rethink public policy toward communications. The papers in this book were first presented at a conference organized by Robert Crandall and Kenneth Flamm, pulling together a group of industry professionals and scholars to address the far-reaching implications of the upheaval in the communications industry. The contributors analyze the effects of this increasing competition on standardization, technical innovation, and international rivalry. Changing the Rules offers possible policy options and analyzes their potential effects on the future market structure and the competitive positions of the U.S. computer and communications industries.
Competition And Regulation by Hongyan Liu, Liner Conferences In Competition Law Books available in PDF, EPUB, Kindle, Docs and Mobi Format. Download Liner Conferences In Competition Law books, A liner conference, as a self-regulation organisational form of liner shipping companies, constitutes a typical "hard-core cartel" with significant anti-competitive effect. One of the main three trade routes of liner shipping traffic is the Europe-Asia Trade, on the two ends of which both the European Community (EC) and the People’s Republic of China (PRC) play important roles in the international liner shipping market. However, the competition regimes on liner conferences in both jurisdictions are not equivalent. From a comparative point of view, this book reviews the historical development of maritime policy and regulatory legislation in the EC and the PRC, catches insight into the system of regulation regime and individual provisions in substantive and procedural meaning, and finally provides a wide-ranging perspective on the future competition regulation in respect of the latest developments in both jurisdictions.

Competition And Regulation by Leuven Centre for a Common Law of Europe. Competition Law Conference, Modernisation Of European Competition Law Books available in PDF, EPUB, Kindle, Docs and Mobi Format. Download Modernisation Of European Competition Law books, The idea of the Modernisation of European Competition Law had been launched by the Commission in late 2000 in a White Paper. The Commission proposed to decentralise the application of the EC competition rules: national authorities and judges would receive new competencies in this area. The modernisation process should dramatically change the scene. Current expectations are that there is a fair chance that the Commission's proposal will be adopted, with some amendments, by the Council before the end of 2002. Following the publication of the White Paper, the Leuven Centre for a Common Law of Europe decided to devote a conference to the subject of Modernisation of EC Competition Law in June 2001. At the time of the Conference, the modernisation idea had been followed by a draft Regulation implementing Articles 81 and 82 EC. This book contains the papers that were delivered at the conference. These papers examine the salient features of the proposed reform and discuss its consequences for European and national competition law and practice. Special emphasis is placed on private enforcement of EC antitrust rules. The editors added a general introduction, setting out the highlights of the modernisation debate, as it was conducted in Leuven. Therefore this book will help to understand this single most important reform of EC competition law since its conception. Contributions to this book are made by T.C. Arthur, Sir C. Bellamy, L. Cornelis, W. Devroe, H. Gilliams, L. Gyselen, K. Lenaerts, J. Stuyck, J. Temple Lang, M. van der Woude and W. van Gerven.
Competition And Regulation by Antōnios M. Antapasēs, Competition And Regulation In Shipping And Shipping Related Industries Books available in PDF, EPUB, Kindle, Docs and Mobi Format. Download Competition And Regulation In Shipping And Shipping Related Industries books, Maritime competition as an economic phenomenon is currently influenced by a number of factors both at EU and international level. From a legislative point of view, the recent repeal of EC Reg. 4056/1986 affects the treatment of horizontal agreements not only in the liner but also in the bulk sector, which was excluded until recently from the scope of EC secondary competition rules. However, competition distortions are not only a question of private arrangements. They emanate also from measures and practices incompatible with the freedom to provide services, Member states protectionism and international mandatory regulation. This volume comparatively and comprehensively examines all these issues, by bringing together contributions from distinguished academics. Particular focus is given on private shipping cartels, the liberalization of cabotage and port services, indirect competition-distorting factors and the latest developments on international regulation of carriage of goods by sea.
Competition And Regulation by Wolf Sauter, Coherence In Eu Competition Law Books available in PDF, EPUB, Kindle, Docs and Mobi Format. Download Coherence In Eu Competition Law books, EU competition law plays a central role in the process of European integration both as a multifaceted tool for creating and policing the internal market as well as in organising national markets. Yet as a consequence of this role it is also subject to increasingly complex demands, a proliferation of (sectoral) regimes, and multiple objectives at both an EU and national level. This profligacy entails risks of fragmentation and divergence - which could jeopardise the proper functioning of the internal market. In this examination of EU competition law, Wolf Sauter discusses three main issues: (i) what degree of coherence exists in EU competition law; (ii) how this coherence can be explained, particularly in the broader context of integration by EU law; and (iii) how it contributes to the legitimacy and effectiveness of EU competition law. Specific focus is placed on antitrust, while mergers, state aid control, as well as the sectoral regimes for energy and electronic communications are also examined. In addition the book also charts the history and framework of these competition regimes that jointly constitute EU competition law, defining both its objectives and limitations.

Download Eu Competition Law And Regulation In The Converging Telecommunications Media And It Sectors books, This book presents the most thoroughgoing model yet offered to ensure the emergence of a genuinely competitive electronic communications industry in Europe. In the course of its in-depth analysis the discussion focuses on such factors as the following: EU telecommunications policy as revealed in liberalization and harmonization legislative measures; the EU electronic communications framework; case law covering issues of refusal to supply and the essential facilities doctrine; application of Article 82 EC to bottlenecks; specific types of an undertakings unilateral behaviour that may often occupy NRAs and competition authorities in the context of their ex post competition law investigations under Article 82 EC; strategic alliances and mergers in the move toward multimedia; access to premium content and the emergence of new media; the scope of content regulation in the online environment; and broadband (regulation of local loop unbundling and bitstream access). The book also provides practical guidance on issues concerning the complicated market definition and analysis mechanism promulgated by the European Commission's Recommendation and Guidelines.
Competition And Regulation by Yane Svetiev, Experimentalist Competition Law And The Regulation Of Markets Books available in PDF, EPUB, Kindle, Docs and Mobi Format. Download Experimentalist Competition Law And The Regulation Of Markets books, This book charts the emergence of experimentalist governance in the implementation of EU competition law as a response to uncertainty and the limits of hierarchical enforcement in an increasingly dynamic and heterogeneous economic environment. It contributes to ongoing debates about the current state of EU competition law and provides an innovative account of emergent enforcement trends and its future direction. It also argues that an experimentalist evolution of competition law and market regulation attenuates concerns about the competitive strictures of EU law on national economic and regulatory institutions. Through its focus on experimentalist governance, the book provides guidance on completing experimentalist infrastructures for market regulation, as well as on the role of courts in triggering and sustaining experimentalist solutions. As such, it offers a novel perspective on implementing competition law in the EU and beyond.
